The terms used hereinafter have, in these Terms and Conditions, the following meaning:
: Refers to the interface in which all the data provided by the CUSTOMER are stored. These data may include their information such as their email address, their personal information, their orders, etc. It is hereby stated that an ACCOUNT cannot be closed by a third party.
““: Refers to the joint contractor for MEME COSMETICS, who guarantees that they have the role of consumer as defined by law and by French jurisprudence. To this end, it is expressly expected that the CUSTOMER should be acting outside of any usual or commercial activity.
““: Refers to all days from 9 am to 6 pm except Saturdays, Sundays and French bank holidays.
““: Refers to the first appearance of the PRODUCTS ordered by the CUSTOMER at the delivery address indicated during the order.
““: Refers to all the cosmetic products marketed by MEME COSMETICS and proposed for sale on the WEBSITE.
These Terms and Conditions regulate the sale of PRODUCTS by MEME COSMETICS to its CUSTOMERS.
The CUSTOMER is clearly informed and recognises that the WEBSITE is aimed at consumers and that professionals must contact the MEME COSMETICS marketing department in order to benefit from different contract conditions. Professionals may request to open an account and consult the specific general terms and conditions by sending an email to email@example.com,
The CUSTOMER agrees to read these Terms and Conditions carefully and to accept them, before proceeding with the payment for an order of PRODUCTS placed on the WEBSITE.
These Terms and Conditions are referenced at the bottom of each page of the WEBSITE by means of a hyperlink and must be consulted before placing the order. The CUSTOMER is requested to read carefully, download and print the Terms and Conditions and to keep a copy of them.
MEME COSMETICS advises the CUSTOMER to read the Terms and Conditions upon each new order, as the most recent version of the aforementioned Conditions applies to any new order of PRODUCTS.
By clicking on the first button to place the order then the second to confirm the aforementioned order, the CUSTOMER recognises having read, understood and accepted the Terms and Conditions with no limitations or conditions.
In order to purchase a PRODUCT, the CUSTOMER must be at least 18 years old and have legal capacity or, if they are a minor, must be able to justify that their legal representatives have given their agreement.
The CUSTOMER will be asked to create an ACCOUNT by proving information to identify them by filling in the form available on the WEBSITE. An asterisk (*) indicates the required fields that must be filled in for the CUSTOMER’s order to be processed by MEME COSMETICS. The CUSTOMER can check the status of their order on the WEBSITE. DELIVERIES may, if necessary, be tracked by using the online tracking tools of certain delivery companies. The CUSTOMER may also contact the MEME COSMETICS sales department by email at any time, at firstname.lastname@example.org, to be given information about the status of the order.
The information that the CUSTOMER provides to MEME COSMETICS during an order must be complete, accurate and up-to-date. MEME COSMETICS reserves the right to ask the CUSTOMER to confirm their identity, their eligibility and the information given by any appropriate measures.
ARTICLE 5.1. Product characteristics
MEME COSMETICS agrees to present the main characteristics of the PRODUCTS (on information sheets available on the WEBSITE) and the required information that the CUSTOMER must be given in virtue of the governing law.
The CUSTOMER agrees to read this information carefully before placing an order on the WEBSITE.
All the PRODUCTS sold by MEME COSMETICS are new and comply with the European legislation in force and the standards applicable in France.
Article 5.2. Ordering procedure
PRODUCT orders are placed directly on the WEBSITE. To place an order, the CUSTOMER must follow the steps detailed below (please note however that the steps may differ slightly depending on the starting page of each CUSTOMER). The CUSTOMER is given the option to create an ACCOUNT to make their future orders easier.
The CUSTOMER should select the PRODUCT(s) that they choose by clicking on the PRODUCT(s) in question and by choosing the desired characteristics and quantities. Once the PRODUCT is selected, the PRODUCT is placed in the CUSTOMER’s basket. The CUSTOMER may then add as many PRODUCTS as they wish to their basket.
Once the PRODUCTS are selected and placed in the basket, the CUSTOMER must click on the basket and verify that the contents of their order are correct. If the CUSTOMER has not yet done so, they will then be asked to log in, to sign up or to provide the required information for an immediate order.
Once the CUSTOMER has validated the contents of the basket and has logged in / signed up or has provided the required information, an online form that has been automatically filled in will appear summarising the price, the applicable taxes and, if applicable, the delivery fees.
The CUSTOMER is asked to verify the contents of their order (including the quantity, the characteristics and the references of the PRODUCTS being ordered, the billing address, the payment method and the price) before validating its contents.
The CUSTOMER can then proceed to paying for the PRODUCTS by following the instructions found on the WEBSITE and providing all of the required information for the billing and the DELIVERY of the PRODUCTS. Concerning the PRODUCTS with options available, these particular references appear when the correct options have been selected. Orders placed must include all of the required information for the order to be processed correctly.
The CUSTOMER must also select their chosen delivery method.
Once all of the steps above are completed, a page appears on the WEBSITE to confirm that the CUSTOMER’s order has been received. A copy of the order confirmation is automatically sent to the CUSTOMER by email, provided that the email address given via the subscription form is correct.
MEME COSMETICS does not send any order confirmations by post or by fax.
During the ordering process, the CUSTOMER must fill in the required billing information (an asterisk (*) indicates the required fields that must be filled in for the CUSTOMER’s order to be processed by MEME COSMETICS.)
In particular, the CUSTOMER must clearly indicate all the information concerning DELIVERY, most importantly the exact DELIVERY address, as well as any potential key codes for the DELIVERY address.
The CUSTOMER must also specify their chosen payment method.
Neither the order form that the CUSTOMER fills in online, nor the order confirmation that MEME COSMETICS sends to the CUSTOMER by email, constitutes a receipt. Whatever method of ordering or payment may be used, the CUSTOMER will receive the original copy of the receipt upon the DELIVERY of the PRODUCTS, inside the parcel.
Article 5.3. Order Date
The order date is the date on which MEME COSMETICS confirms that they have received the order online. The time periods indicated on the WEBSITE begin only from this date.
Article 5.4. Price
For all the PRODUCTS, the CUSTOMER will find prices displayed on the WEBSITE in euros including all taxes, and the applicable delivery fees (based on the weight of the parcel, not including packaging and freebies, the DELIVERY address and the delivery company or mode of transport chosen).
The prices notably include the value added tax (VAT) at the rate in force on the date of the order. Any modification of the applicable rates may impact the price of the PRODUCTS as of the date that the new rates come into force.
The applicable VAT rate is expressed as a percentage of the value of the PRODUCT being sold.
The prices of the suppliers for MEME COSMETICS are susceptible to change. Consequently, the prices indicated on the WEBSITE may change. They may also be changed in the event of offers or sales.
The prices indicated are valid, with the exception of gross miscalculation. The price that applies is the price indicated on the WEBSITE on the date on which the order is placed by the CUSTOMER.
Article 5.5. PRODUCT availability
The professional commits to delivering the PRODUCT on the date or within the time period indicated to the CUSTOMER, unless the parties have agreed otherwise.
If a PRODUCT is unavailable, this will in principle be indicated on the page for the PRODUCT in question. MEME COSMETICS may also inform the CUSTOMERS of a PRODUCT being restocked.
In any event, if the unavailability has not been indicated at the time that the order is placed, MEME COSMETICS agrees to inform the CUSTOMER as soon as possible if the PRODUCT is unavailable.
Assuming that a PRODUCT is unavailable, MEME COSMETICS may, if the parties agree to it, propose an alternative PRODUCT of an equivalent quality and price, that is accepted by the CUSTOMER.
If the CUSTOMER decides to cancel their ORDER of the unavailable PRODUCTS, they will be refunded for the total sum of money paid for the unavailable PRODUCTS within a maximum of thirty (30) days of the payment.
The procedures for the right of withdrawal are outlined in the “Withdrawal Policy”, a policy which is available in of these Conditions and can be accessed via a hyperlink at the bottom of each page of the WEBSITE.
The CUSTOMER is informed that for certain products sold on the WEBSITE, the right of withdrawal is not applied to sealed goods that cannot be returned for health protection or hygiene reasons and that have had their seal broken by the CUSTOMER after the DELIVERY.
Article 7.1. Payment methods
The CUSTOMER can pay for the online PRODUCTS on the WEBSITE by following the methods proposed by MEME COSMETICS.
For payments by debit card, MEME COSMETICS uses the services of HiPay, whose terms and conditions can be found at the following link: www.hipay.com
Before any payment using a Debit Card, the CUSTOMER is asked to read and accept the terms and conditions of HiPay
The CUSTOMER provides MEME COSMETICS with a guarantee that they have all the authorisations required to use their chosen payment method.
MEME COSMETICS will take all the measures necessary to guarantee that the data sent online for online payment via the WEBSITE remain safe and confidential.
To this end, it is specified that all the information provided by the WEBSITE concerning the payment are sent to the WEBSITE’s bank and are not processed by the WEBSITE.
Article 7.2. Payment date
In the event of a one-time payment using a credit card, the CUSTOMER’s account will be debited as soon as the order of the PRODUCTS is placed on the WEBSITE.
In the event of partial DELIVERY, the total amount will be debited from the CUSTOMER’s account as soon as possible after the first parcel is shipped. If the CUSTOMER decides to cancel their order for unavailable PRODUCTS, they will be refunded in compliance with the final paragraph of article 5.5 of these Terms and Conditions.
Article 7.3. Late or refused payment
If the bank refuses to debit a card or another payment method, the CUSTOMER must contact MEME COSMETICS Customer Services in order to pay the order using any other valid method of payment.
In the event that, due to cancelling, refusal or any other reason, the transfer of money owed by the CUSTOMER proves to be impossible, the order will be cancelled and the sale will be automatically terminated.
Any contract closed with the CUSTOMER for an order of an amount exceeding 120 euros including all taxes will be archived by MEME COSMETICS for a duration of ten (10) years, in compliance with article L. 213-1 of the French Consumer Code.
MEME COSMETICS agrees to archive this information in order to ensure that the transactions are monitored and to produce a copy of the CUSTOMER’s order contract.
In the event of litigation, MEME COSMETICS will be able to prove that their electronic monitoring system is reliable and that it guarantees the integrity of the transaction.
MEME COSMETICS remains the owner of the PRODUCTS delivered until they have been paid for by the CUSTOMER in their entirety.
The above arrangements do not negate the fact that, for PRODUCTS that are subject to retention of title, the risk of loss or damage, as well as the risk of damage that they may cause, is transferred to the CUSTOMER, when they themselves, or a third party other than the delivery company, receive the PRODUCTS.
The procedures for the DELIVERY of PRODUCTS are outlined in the “Delivery Policy”, found in of this document and can be accessed via a hyperlink at the bottom of each page of the WEBSITE.
The PRODUCTS will be packaged in compliance with the transport regulations in force, in order to guarantee maximum protection for the PRODUCTS during the DELIVERY.
The CUSTOMERS agree to follow the same regulations when they return the PRODUCTS under the conditions stated in Annex 1 - Withdrawal Policy.
Other than any commercial guarantees that MEME COSMETICS may propose for certain PRODUCTS, all CUSTOMERS are covered by “legal” guarantees, for all PRODUCTS, which are detailed below, in compliance with article L.111-1 of the French Consumer Code.
Article 12.1. Conformity guarantee : “
MEME COSMETICS are also liable for defects of conformity that were present at the time of issuing and defects of conformity resulting from the packaging, the assembly instructions or the installation when this was charged to them by the contract or was performed under their responsibility.
Action resulting from the defect of conformity lapses after two (2) years from the PRODUCT issuing date ()
In the event of a defect of conformity, the CUSTOMER may request that the PRODUCT is replaced or repaired, as they choose. However, if the cost of the CUSTOMER’s choice is manifestly disproportionate based on the alternative possible option, based on the value of the PRODUCT or the significance of the defect, MEME COSMETICS may provide a refund, without respecting the option chosen by the CUSTOMER.
Assuming that replacing or repairing the PRODUCT would be impossible, MEME COSMETICS agrees to refund its price within thirty (30) days of receiving the returned PRODUCT and in exchange for the CUSTOMER returning the PRODUCT to the following address: MEME COSMETICS 19 rue Cail 75010 PARIS, FRANCE.
Finally, the CUSTOMER is exempt from providing proof of the existence of the PRODUCT’s defect of conformity for twenty-four (24) months after the PRODUCT is delivered, or six (6) months in the case of second-hand goods. ()
It is specified that this legal conformity guarantee applies independently of the agreed commercial guarantee, if applicable, for the PRODUCTS.
Article 12.2. Guarantee for hidden defects
MEME COSMETICS is bound by the guarantee for any hidden defects of the PRODUCT sold which render it unsuitable for the use for which it was intended, or which diminishes its use to such an extent that the CUSTOMER would not have bought it, or would have paid a lesser price for it, had they been aware of them.
This guarantee allows a CUSTOMER who can prove the existence of a hidden defect to choose between a refund of the price of the PRODUCT if it is returned or a partial refund of its price, if the PRODUCT is not returned.
Assuming that replacing or repairing the PRODUCT would be impossible, MEME COSMETICS agrees to refund its price within thirty (30) days of receiving the returned PRODUCT and in exchange for the CUSTOMER returning the PRODUCT to the following address: MEME COSMETICS 19 rue Cail 75010 PARIS, FRANCE. Action resulting from redhibitory defects must be taken by the CUSTOMER within two (2) years of the defect being discovered. (
MEME COSMETICS cannot in any case be liable in the event of the non-fulfilment or the incorrect fulfilment of the contractual obligations attributable to the CUSTOMER, particularly when placing the order.
MEME COSMETICS cannot be held responsible or be considered to be in breach of this document, for any late fulfilment or non-fulfilment, when the cause of this late fulfilment or non-fulfilment is linked to a case of force majeure as defined by the jurisprudence of the French court and court of appeals.
It is also specified that MEME COSMETICS does not control any websites that are directly or indirectly linked to the WEBSITE. Consequently, they are exempt from any liability towards the information that is published there. The links to third-party websites are provided for information purposes only and no guarantee is provided as to their contents.
MEME COSMETICS collects personal data about their CUSTOMERS on the WEBSITE, including via cookies. The CUSTOMERS can deactivate the cookies by following the instructions provided by the navigator.
The data collected by MEME COSMETICS are used to process orders placed on the WEBSITE, to manage the CUSTOMER’s account, to analyse orders and, if the CUSTOMER has chosen this option, to send them marketing emails, newsletters, promotional offers and/or information about sales, unless the CUSTOMER no longer wishes to receive these messages from MEME COSMETICS.
The CUSTOMER’s data are stored confidentially by MEME COSMETICS in compliance with their declaration to the French Data Protection Authority (CNIL), which covers the contract and its execution and is in accordance with the law.
The CUSTOMERS may unsubscribe at any time by logging in to their account or by clicking on the hyperlink provided at the bottom of each offer received by email.
The data may be shared, in whole or in part, with the MEME COSMETICS service providers that intervene in the order process. For commercial reasons, MEME COSMETICS can send their trading partners the names and contact details of their CUSTOMERS, providing that the latter have given their prior consent when signing up to the WEBSITE.
MEME COSMETICS will specifically ask the CUSTOMERS if they wish for their personal data to be shared. The CUSTOMERS may change their minds at any time by contacting MEME COSMETICS. MEME COSMETICS may also ask their CUSTOMERS if they wish to receive commercial offers from their partners.
In compliance with French law no. 78-17 of 6th January 1978 regarding data protection, the CUSTOMER has the right to access, to correct, to oppose (for legitimate reasons) and to delete their personal data. They may exercise this right by sending an email to the following address: email@example.com or by sending a letter to MEME COSMETICS 19 rue Cail 75010 PARIS, FRANCE.
It is specified that the CUSTOMER must be able to prove their identity, either by scanning a proof of identity document, or by sending a photocopy of their proof of identity document to MEME COSMETICS.
The CUSTOMER has the option to publish a comment about the PRODUCTS on the WEBSITE. MEME COSMETICS uses the services of Avis Vérifiés. The CUSTOMER is asked to read and accept the terms and conditions of Avis Vérifiés, which are available via the following link: https://www.avis-verifies.com/index.php?page=mod_conditions_utilisation, which will provide them with more information about the conditions under which the comments are processed and published.

All of the image and sound elements on the WEBSITE, including the underlying technologies used, are protected by copyrights, trademarks and/or patents.
These elements are the exclusive property of MEME COSMETICS. Any person producing a website and who wishes to insert a direct hyperlink to the WEBSITE must send a written request for authorisation to MEME COSMETICS.
This authorisation from MEME COSMETICS will not in any case be given permanently. This link will have to be deleted if MEME COSMETICS so requests. Hyperlinks to the WEBSITE that use techniques such as framing or in-line linking are strictly prohibited.
Any modifications to the legislation or the regulations in force, or any decision by a competent court that invalidates one or several of the clauses of these Terms and Conditions will not affect the validity of these Terms and Conditions. A modification or decision of this kind does not in any way authorise the CUSTOMER to be ignorant of these Terms and Conditions.
Any conditions that are not expressly covered in this document will be governed in accordance with practice in the private retail sector, for companies whose registered office is located in France.
These Terms and Conditions apply to all online purchases on the WEBSITE, for so long as the WEBSITE is available online.
The Terms and Conditions are dated precisely and may be modified and updated by MEME COSMETICS at any time. The Terms and Conditions that apply are those in force at the time of the order.
Any modifications made to the Terms and Conditions will not apply to PRODUCTS that have already been bought.
These Terms and Conditions and the contact between the CUSTOMER and MEME COSMETICS are governed by French law.
In the event of litigation, the only competent court will be the French court.
However, prior to any remedy involving arbitration or the state court, the CUSTOMER is invited to contact the MEME COSMETICS complaints department.
If no agreement is found or if the CUSTOMER can justify having previously tried to resolve the litigation directly with MEME COSMETICS by means of a written complaint, they will then be offered voluntary mediation, in a spirit of loyalty and good faith, with the aim of reaching an amiable agreement during the occurrence of any conflict related to this contract, including any conflict concerning its validity.
The party that wishes to instate the mediation process must give prior warning to the other party via a registered letter with acknowledgement of receipt, indicating the elements of conflict.
As mediation is not mandatory in nature, the CUSTOMER or MEME COSMETICS may pull out of the process at any time.
In the event that the mediation fails or is not considered, the litigation that could have given rise to mediation will be entrusted to the competent jurisdiction mentioned above.
As a matter of principle, the CUSTOMER has the right to withdraw by sending back or returning the PRODUCT to MEME COSMETICS.
To do so, the PRODUCT must be sent back or returned without excessive delays, and within a maximum of fourteen (14) days of communicating their decision to withdraw, unless MEME COSMETICS proposes to retrieve the PRODUCT themselves.
In compliance with article L.221-18 of the French Consumer Code, the withdrawal period ends fourteen (14) days after the day when the CUSTOMER, or a third party chosen by the CUSTOMER, other than the delivery company, physically takes possession of the PRODUCT.
In the event that the CUSTOMER has ordered several PRODUCTS via one single order that leads to several DELIVERIES (or in the event that an order for a single PRODUCT is delivered in several batches), the withdrawal period ends fourteen (14) days after the day when the CUSTOMER, or a third party chosen by the CUSTOMER, other than the delivery company, physically takes possession of the final PRODUCT delivered.
If the CUSTOMER’s order is for several PRODUCTS and if these PRODUCTS are delivered separately, the withdrawal period ends fourteen (14) days after the day when the CUSTOMER, or a third party chosen by the CUSTOMER, other than the delivery company, physically takes possession of the final PRODUCT.

In order to respect the withdrawal period, the CUSTOMER must send their form of communication to exercise their right of withdrawal before the withdrawal period ends.
In the event of a withdrawal from the CUSTOMER, MEME COSMETICS agrees to refund the full amount paid, including delivery fees (with the exception of any extra fees resulting from, if applicable, the CUSTOMER having chosen a delivery method other than the standard delivery method proposed by MEME COSMETICS) without excessive delays and, in any event, within a maximum of fourteen (14) days of MEME COSMETICS receiving the returned PRODUCT. MEME COSMETICS will proceed to a refund using the same payment method used by the CUSTOMER for the initial transaction, unless the CUSTOMER expressly requests a different method, and in any event, this refund will not cause the CUSTOMER to incur any costs.
MEME COSMETICS is under no obligation to refund the extra fees if the CUSTOMER expressly chose a delivery method that is more expensive than the standard method proposed by MEME COSMETICS.
MEME COSMETICS may defer the refund until the good has been received or until the CUSTOMER has provided a proof that the good has been shipped, whichever date is earliest.
The CUSTOMER must, without excessive delays and, in any event, within a maximum of fourteen (14) days of communicating their decision to withdraw from this contract, return the good to:

This period is considered to be respected if the CUSTOMER returns the good before the end of the fourteen (14) day period.
The CUSTOMER must pay the direct fees for returning the good.
In the event that the weight of the PRODUCT would prevent the CUSTOMER from returning this PRODUCT by their country’s postal service, the CUSTOMER must pay the direct fees for returning the good.
The instructions given by MEME COSMETICS must be followed by the PRODUCT and in particular all of the accessories delivered must be included.
The CUSTOMER is only held responsible with regard to the depreciation of the good resulting from any manipulations other than those which are necessary to establish the nature, the characteristics and the proper functioning of this PRODUCT. In other words, the CUSTOMER has the opportunity to test the PRODUCT but they may be held responsible if they carry out any manipulations other than those which are necessary.
The right of withdrawal is excluded particularly in the following cases:
· The provision of goods created according to the CUSTOMER’s specifications or clearly personalised
· The provision of goods that are likely to deteriorate or expire quickly
· The provision of goods that by their nature are combined with other articles in such a way that they cannot be disassociated
· The provision of sealed goods that cannot be returned for health protection or hygiene reasons and that have had their seal broken by the CUSTOMER after the DELIVERY
The PRODUCTS offered can only be delivered within the TERRITORY.
It is impossible to place an order to any delivery address located outside of the TERRITORY.
The PRODUCTS are shipped to the delivery address(es) that the CUSTOMER has indicated during the ordering process.
The time taken to prepare an order, create the receipt, then ship the PRODUCTS in stock is mentioned on the WEBSITE. These periods do not include weekends or bank holidays.
An electronic message will automatically be sent to the CUSTOMER when the PRODUCTS are dispatched, providing that the email address found on the inscription form is correct.
During the ordering process, MEME COSMETICS indicates the shipping times and available shopping options to the CUSTOMER for the PRODUCTS bought.
The shipping costs are calculated based on the delivery method.
Two DELIVERY methods are proposed by the WEBSITE:
for orders of less than €49 euros.
Free for orders of 49 euros or more
working days from when the parcel is received by the delivery company
Using a MONDIAL RELAY pickup point
for orders of less than €49 euros.

The DELIVERY costs will be charged to the CUSTOMER in addition to the price of the PRODUCTS bought.

In the absence of an indication or an agreement concerning the delivery date, MEME COSMETICS will deliver the PRODUCT without unjustified delays and within a maximum of thirty (30) days of closing the contract. ()
The parcel will be given to the CUSTOMER after a signature and a proof of identity document have been provided.
If the CUSTOMER is absent, a delivery notice will be left, allowing them to pick up the parcel at their post office.
The CUSTOMER is informed of the delivery date that is fixed at the time of choosing the delivery company, at the end of the online ordering procedure, before confirming the order.
It is specified that deliveries will be carried out within a maximum of thirty (30) days. Otherwise, the CUSTOMER must give notice to MEME COSMETICS to deliver within a reasonable time period and in the event that the delivery does not occur during this time period, they may cancel the contract.
MEME COSMETICS will refund the CUSTOMER, without excessive delays after receiving the cancellation letter, for the total amount paid for the PRODUCTS, including taxes and delivery fees, using the same payment method as that used by the CUSTOMER to buy the PRODUCTS.
MEME COSMETICS is held responsible until the PRODUCT is DELIVERED to the CUSTOMER. The CUSTOMER is reminded that they have three (3) days to notify the delivery company of any damage or partial loss that occurred during delivery.
